The website IP Video Market Info, which reviews technology, posted an unfavorable review of a new device said to detect fever in 2020 as the Covid pandemic was just starting, reports the Reporters Committee for Freedom of the Press. 

The maker of the “Feevr” device, X.Labs, sued IPVM for defamation, taking exception to the website’s claim that the device was inaccurate.

The website lost in district court, but it was a different story before a 9th Circuit panel.

“The panel concluded that X.Labs failed to adequately plead that anything in IPVM’s reviews was false, including references to Feevr’s accuracy and the company’s misleading marketing claims about the device,” the Reporters Committee wrote.
